SHEERR WEATHER WEATHER PHOTO CONTEST RULES

1. DEFINITIONS

1.1 “Contest Host” refers to Sheerr Weather and its authorized representatives. 

1.2 “Sponsor” refers to the entity or entities providing services or products as part of the contest promotion. 

1.3 “Participant” refers to any individual who enters the contest, subject to the eligibility requirements outlined herein. 

1.4 “Prize” refers to the reward(s) offered in the contest, as further detailed in Section 4. 

1.5 “Contest Period” refers to the duration during which entries are accepted, as specified in Section 3 herein. 

1.6 “Official Rules” refers to these terms and conditions.

2. ELIGIBILITY

2.1 Residency Requirements: The contest is open to residents of Newfoundland and Labrador only.

2.2 Age Restrictions: Participants must be at least the age of majority in their province/territory of residence at the time of entry. 

2.3 Excluded Entities: Employees, representatives, and agents of the Contest Host, Sponsor(s), their respective affiliates, subsidiaries, and immediate family members are not eligible to participate. 

2.4 Sponsor Participation: Participants sponsored by or directly represented by one of the Sponsor(s) are ineligible unless expressly communicated in writing by the Contest Host. 

2.5 Compliance: Participants must comply with all applicable laws, these Official Rules, and any additional requirements specified therein.

3. CONTEST ENTRY

3.1 Entry Methods: Participants may enter online at sheerrweather.ca or by a no-purchase mail-in entry: Print full name, address, phone, and email on paper and mail in a stamped envelope to: Sheerr Weather Contests, P.O. Box 1055 Torbay STN Main, NL, A1K 1K8. One entry per envelope. No purchase necessary. 

3.2 Frequency of Entry: Each Participant may submit one entry per day during the Contest Period unless otherwise specified. Duplicate or fraudulent entries will result in disqualification. 

3.3 Skill-Testing Question: To comply with Canadian law under the Criminal Code, all potential Prize winners are required to correctly answer a skill-testing mathematical question before receiving their Prize.

3.4 Entry Deadline: All entries must be received by 5:00 pm Newfoundland Time on the day before the draw in question, as published on the Contest Host’s website. Late submissions will not be accepted under any circumstances. 

3.5 Certification of Entry Compliance: By entering, Participants certify that they have read, understood, and agreed to abide by these Official Rules.

4. PRIZE DETAILS AND ALLOCATION 

4.1 Description of Prizes: Details about the Prize(s), approximate retail value(s), and any restrictions on use will be available at sheerrweather.ca. 

4.1.1 The prize is a Honda HSC622CTDI Track Drive ES Snowblower. The value of the snowblower, according to Honda Canada, is $2,998.00

4.2 Prize Fulfillment Timelines: Prize(s) shall be delivered to confirmed winners within 30 days of winner notification and completion of all required documentation, subject to unforeseen circumstances detailed in Section 10. 

4.3 Odds of Winning: The odds of winning are contingent upon the total number of eligible entries received during the Contest Period. 

4.4 Regional Allocation: If applicable, Prize distribution will adhere to regional allocation guidelines specified in the Official Rules to ensure equitable distribution. 

4.5 Winner Confirmation: Potential winners must complete and return all required winner confirmation forms, including a Declaration and Release Form and proof of eligibility, within the timeframe specified by the Contest Host. Failure to comply will result in forfeiture of Prize. 

4.6 Prize Substitution: The Contest Host reserves the right to replace any Prize with one of equal or greater value where necessary due to unforeseen circumstances.

5. SPONSOR-SPECIFIC TERMS 

5.1 Sponsor Liability: Any liability or dispute arising directly from the conduct, services, or product(s) provided by the Sponsor(s) shall be the exclusive responsibility of the Sponsor(s). The Contest Host is indemnified against such claims as outlined in Section 7. 

5.2 Representation by Sponsor: The Sponsor(s) agree to comply with all applicable laws, including contest-related regulations and advertising disclosure standards. 

5.3 Sponsor Indemnification: Sponsor(s) shall indemnify, defend, and hold harmless the Contest Host from any claims, damages, or liabilities arising from defective products, false advertising, or any unlawful conduct related to the contest.

6. SOCIAL MEDIA-SPECIFIC TERMS 

6.1 Platform Rules: If hosted via a social media platform, the contest is subject to that platform’s rules and regulations. Participants must adhere to [e.g., Facebook, Instagram] promotion policies as applicable. 

6.2 Sponsorship Disclosure: All promotional materials tied to the contest shall comply with the Competition Bureau's endorsement guidelines and platform-specific disclosure rules to prevent misleading content. 

6.3 User-Generated Content: By submitting content (e.g., photos, videos), Participants grant the Contest Host and Sponsor(s) a perpetual, royalty-free, non-exclusive licence to use such materials for administering the contest and for promotional purposes. Submitted content must

not infringe any third-party rights, violate intellectual property laws, or contain defamatory or offensive material. 

6.4 Moderation Policy: The Contest Host reserves the right to review, approve, or disqualify any submissions based on compliance with these Official Rules or community standards of the respective platform.

7. LIABILITY DISCLAIMER AND INDEMNITY 

7.1 Disclaimer of Warranties: The Contest Host and Sponsor(s) make no representations or warranties regarding reliability, availability, or uninterrupted operation of the contest platform, nor the suitability or merchantability of the Prize(s). 

7.2 Limitation of Liability: The Contest Host and Sponsor(s) shall not be liable for any damages arising from technical failures, system malfunctions, fraudulent entries, or Participant misuse. 

7.3 Indemnification: Participants agree to indemnify, defend, and hold harmless the Contest Host, Sponsor(s), and related third parties for any claims, damages, or liabilities arising from breaches of these Official Rules or Participants negligence.

8. PRIVACY AND DATA HANDLING 

8.1 Collection of Data: The Contest Host collects personal information solely for the purposes of contest administration, winner verification, and marketing (where permitted). 

8.2 Retention Period: Personal data collected will be retained for no longer than 12 months following the conclusion of the Contest Period, after which it will be securely deleted unless retention is required by law. 

8.3 Data Protection Compliance: All personal information is handled in accordance with PIPEDA and other applicable Canadian privacy laws. 

8.4 Opt-Out Mechanism: Participants may opt out of marketing communications at any time by following the instructions provided in the Contest Host’s Privacy Policy.

9. FORCE MAJEURE 

9.1 Exemption from Liability: The Contest Host shall not be responsible for delays or cancellations arising from events beyond its reasonable control. In such cases, the Contest Host may suspend, postpone, or cancel the contest and may, at its sole discretion, award substitute prizes of equal or greater value. 

9.2 Remedial Actions: In the event of a Force Majeure, the Contest Host will notify Participants of any changes to the contest timeline and provide alternative measures where feasible.

10. GOVERNING LAW AND DISPUTE RESOLUTION 

10.1 The Official Rules and the contest shall be governed by the laws of Newfoundland and Labrador, with federal laws preempting where applicable. 

10.2 Disputes arising out of or related to this contest shall be resolved by the courts of Newfoundland and Labrador, unless otherwise precluded by mandatory local laws.

11. ACCEPTANCE OF RULES 

11.1 By entering the contest, Participants confirm they have read, understood, and agree to be bound by these Official Rules.

12. ACCEPTANCE OF RULES 

12.1 The Contest Host reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process or violates these Official Rules, and to cancel, modify, or suspend the contest should any cause beyond its control corrupt the administration, security, or proper play of the contest. 

12.2 By entering the contest, Participants confirm they have read, understood, and agree to be bound by these Terms and Conditions.
